Automated stock trading in the US: how a retail bot works

Automated stock trading for a US retail investor means a program placing orders on your own brokerage account by fixed rules, through the broker's API. Tens of thousands of people do it on Alpaca and Interactive Brokers today, most with code they wrote themselves. The plumbing
You open a brokerage account — Alpaca for commission-free stocks and ETFs with a clean API, Interactive Brokers for options, portfolio margin and global markets — and create an API key. The key can read positions and place or cancel orders; it cannot move money out. The bot runs on a server, reads prices after the close (or intraday), and sends orders with stops attached. Funds and securities stay in your account under SIPC protection; revoke the key and the bot is gone.
The rules that bite
Pattern day trader. Four or more round-trip day trades in five business days on a margin account under $25,000 gets the account flagged. End-of-day systems that hold for days rarely trip it; cash accounts never do. Margin. Reg T lets you borrow against positions; a bot that uses it has to respect maintenance margin or face liquidation. Options. Approval levels at your broker decide what strategies you can run; defined-risk spreads need a lower level than naked shorts. Taxes. Short-term gains at ordinary rates, wash sales disallowed, 1099-B from the broker.
What AI adds, and what it does not
Most "AI trading" in the US retail market is one of three things: a rule-based bot with an AI label, a machine-learning layer choosing among rules or sizing positions, or a language model that explains and researches. Questions people ask
Is automated trading legal for US retail investors?
Yes, on your own brokerage account through a broker API such as Alpaca or Interactive Brokers. FINRA's pattern-day-trader rule and your broker's margin terms still apply. A service that pools client money or gives personalised advice for a fee needs SEC or state registration; software that runs rules on your own account does not.
Does the pattern-day-trader rule affect a bot?
If the account is under $25,000 and the bot opens and closes the same position four or more times in five business days on margin, yes. Firefly Nova's rules are end-of-day and hold for days to weeks, so they rarely trigger PDT; a cash account avoids it entirely.
How are automated trades taxed in the US?
Like any trades: short-term capital gains at ordinary rates for positions held a year or less, long-term rates beyond that, and the wash-sale rule applies when a loss is repurchased within 30 days. Options have their own rules. Your broker's 1099-B reports it; a CPA files it.
Can I run it from outside the US?
Alpaca and Interactive Brokers accept non-US residents in many countries. UAE and Gulf residents open directly; Indian residents fund under the RBI's LRS limits. Firefly Nova works the same in each case.
